Calgary caregiver loses appeal to stay in Canada after sex assault

CALGARY – The caregiver at a nursing home who sexually assaulted an 86-year-old woman with dementia has lost his appeal to avoid deportation back to Peru.

Cesar Benjamin Guzman, now 75, lost an appeal to the Immigration and Refugee Board in a decision announced today.

Guzman was caught in the act of sexually assaulting the woman by a nurse who reported it immediately. He pleaded guilty and spent 11 months in jail and was ordered deported in 2007.

However, he fought to stay in the country on compassionate grounds arguing that his family, particularly his adult daughter who has medical problems, need him.

“The appellant failed to “behave” in a most egregious manner while in Canada. In the circumstances, I do not find a basis for granting a stay of the deportation order,” wrote Maryanne Kingma in her decision.

Guzman was a doctor in Peru before moving to Canada in 1998 to be with his family.
